1. Marubeni statement

Marubeni Thailand Co., Ltd. ("Marubeni," "we," "our," or "us") is aware that the proper management and protection of Personal Data (defined below) is an important responsibility in the course of conducting businesses and services.

Therefore, Marubeni issues this privacy notice (the "Privacy Notice") to describe the collection, use, and disclosure (collectively, "processing") of your Personal Data, whether this Personal Data pertains to you as a customer, prospective customer, supplier, prospective supplier, contact person or representative or personnel of those persons, visitor, or government official ("you" or "your").

Marubeni will make our best efforts to ensure that all of our personnel will comply with this Privacy Notice.

2. Privacy Notice extent

This Privacy Notice applies to all communication channels, both online and offline, whether face-to-face, over the phone, or via any other means used in communications for any activities, unless another specific privacy policy applies.

3. Update to this Privacy Notice

This Privacy Notice may be periodically updated to reflect changes in the personal data protection law, other applicable laws, and our practice. Marubeni indicates version and date of the Privacy Notice at the top of this Privacy Notice for your ease of reference.

Marubeni recommends that you revisit this Privacy Notice periodically to learn of any changes. If any changes require your consent under the applicable laws, Marubeni will obtain your consent beforehand.

5. Personal Data

Under this Privacy Notice, "Personal Data" means any information relating to a person that enables the identification of that person, whether directly or indirectly.

6. Collection of Personal Data

Marubeni collects your Personal Data that is provided by you, collected in the process of providing goods and services, provided by any third parties, or obtained from external sources. Your Personal Data to be collected includes but is not limited to the following:

  • Identity Data

Your name, surname, age, date of birth, job data, job position, signature, car license plate number, bank account data, photographs and videos of you, national identification card data, passport data, drivers license data, data in other types of identity document issued by a government (excluding the Sensitive Data), and any other data that is able to verify your identity (collectively, "Identity Data");

  • Contact Data

Your personal or business phone number, mobile number, fax number, address, and email address, as well as your social media profile (collectively, "Contact Data");

  • Business Transaction Data

Your business transactions with Marubeni, agreement data, services or products purchased, contact history, company directors and shareholders, comments, questions, inquiries, feedback, or survey responses (collectively, "Business Transaction Data");

  • Sensitive Data

Your religion and blood type (collectively, "Sensitive Data"); and

  • Cookies and Web Beacons Data

Your IP address, cookies, web beacons, log, browser and devices data, surfing time, and log in data (collectively, "Cookies and Web Beacons Data").

In various situations, Marubeni does not intend to process your Sensitive Data. However, as the Sensitive Data is contained in several identity documents, e.g. national identification card, Marubeni may conceal or ask you to conceal the Sensitive Data contained in those documents so that Marubeni will not process the unnecessary Sensitive Data.

If you provide Marubeni with any Personal Data of other persons, you are obliged to ensure and warrant that you have the authority to do so in accordance with this Privacy Notice and such other persons have been informed of this Privacy Notice.

7. Minor's Personal Data

Marubeni's activities are generally not aimed at any person who is a minor. If Marubeni learns that Marubeni has collected Personal Data of any minors, Marubeni will proceed to comply with the applicable law promptly. If you are a minor and consent for Marubeni to process your Personal Data, you must indicate that your legal representative has consented to you doing so.

8. Personal Data Processing

Marubeni processes your Personal Data for the purposes below on legal basis, e.g. your consent, contractual obligation, Marubeni's legitimate interest, legal obligation, vital interest, and the establishment and defense of legal claims.

If Marubeni processes your Personal Data based on your consent, you are able to withdraw your consent at any time as described in item 13 below by contacting Marubeni as provided in item 4 above.

Your Personal Data is required for the purposes below. Otherwise, Marubeni may not be able to undertake any intended actions with you. The purposes of processing include but are not limited to the following (collectively, the "Purposes").

  • Business transaction purpose

Your Identity Data, Contact Data, and Business Transaction Data are processed on a contractual obligation basis and Marubeni's legitimate interest basis in order to determine whether to enter agreements with you or your corporate entity, to authenticate and verify your identity, to keep as records and evidence, to order products or services, to provide quotations, to contact your corporate entity regarding agreements, to perform contractual obligations, to provide products and services for your corporate entity, to analyze and prepare information for purchase orders, to manage deliveries and shipments, to manage payments, to provide after-sale services, to facilitate transactions, to administer product returns, and for other transactional undertakings.

  • Provision of information purpose

Your Identity Data, Contact Data, and Business Transaction Data are processed on Marubeni's legitimate interest basis in order to analyze and respond to your comments, questions, inquiries, or feedback, to provide you with information related to our products and services, to provide up-selling information or promotions, to contact for governmental purposes, and to provide other relevant information of terms and conditions or this Privacy Notice or other related documents to you.

  • Operation purpose

Your Identity Data, Contact Data, and Business Transaction Data are processed on Marubeni's legitimate interest basis in order to manage and improve business operations, to conduct audits, to manage internal business compliance, to implement terms and conditions or this Privacy Notice or relevant documents, to conduct and analyze market research, to develop products and services, to analyze the efficiency of promotions and advertisements, to customize strategy, to analyze both online and offline communication channels, to enhance online security, and for other operational purposes.

  • Legal compliance purpose

Your Identity Data, Contact Data, and Business Transaction Data are processed on a legal obligation basis in order to act in accordance with Marubeni's legal obligations and rights under the applicable law, to establish or comply with or exercise or defend against legal claims in the future, and for other legal compliance purposes.

  • Security purpose

Your Identity Data, especially video of you as captured by CCTVs, are processed on Marubeni's legitimate interest basis in order to maintain security.

  • Identification and record purpose

Your Sensitive Data as shown in your identity document may be processed with your consent in order to authenticate and verify your identity, and to keep as records and evidence.

9. Personal Data Retention

Marubeni will retain your Personal Data for only as long as reasonably necessary to fulfil the Purposes. If a judicial action is initiated, your Personal Data may be retained until this action ends, including during any potential period for appeal, and will then be deleted or archived, as permitted by applicable law.

10. Security Measure

Marubeni implements the appropriate physical and electronic security measures in retaining your Personal Data and to prevent it from being accidentally lost, or used, accessed, damaged, destroyed, altered, or disclosed without authorization. The physical security measures include locked lockers and access-controlled premises. The electronic security measures include limited access-control and antivirus protection. Marubeni will also promptly take corrective actions upon the occurrence of a security incident.

11. Disclosure of Personal Data

For the Purposes above, Marubeni may disclose your Personal Data to our parent company, affiliates, subsidiary companies, group companies, business partners, service providers, IT solution, suppliers, customers, sub-contractors, external advisors, auditors, government agencies, or any other third parties, whether private or governmental. Marubeni will make our best effort to ensure that those who receive your Personal Data will have adequate personal data security standards according to the applicable law.

Marubeni may also disclose, share, or transfer any of your Personal Data if Marubeni sells or transfers all or a portion of our business or assets, including but not limited to in a merger, acquisition, amalgamation, or joint venture.

12. Cross-border transfer of Personal Data

Marubeni may sometimes disclose, share, and transfer your Personal Data to locations outside Thailand where its personal data protection standards may be inferior to those under Thai laws, e.g. Japan, for the Purposes. In such a case, Marubeni will seek your explicit consent prior doing so and ensure that those who will receive your Personal Data will have adequate personal data security standards under the applicable law.

13. Your rights

You have the rights regarding your Personal Data as described below. Please contact Marubeni as provided in item 4 if you wish to exercise any of these rights. Marubeni may require you to prove your identity before complying with your request or exercise of rights in order to protect your own privacy and security.

  • Right to access

You have the right to access or request copies of your Personal Data. Marubeni will only provide you with access to the Personal Data contained in the documents requested, and not to the full documents themselves.

  • Right to rectification

You have the right to rectify your incomplete, inaccurate, misleading, or out-of-date Personal Data.

  • Right to data portability

You have the right to obtain your Personal Data you have given to Marubeni or to request the transfer of your Personal Data to any third parties if such Personal Data is processed with your consent or on a contractual basis.

  • Right to object

You have the right to object to the collection, use, or disclosure of your Personal Data in certain cases.

  • Right to erasure

You have the right to request that Marubeni delete, destroy, or anonymize your Personal Data in certain cases, including but not limited to when the Personal Data is no longer necessary for the Purposes, or when your Personal Data has been unlawfully collected, used, or disclosed.

  • Right to restriction

You have the right to request that Marubeni restrict our use of your Personal Data in certain cases,

  • Right to withdraw consent

You have the right at any time to withdraw your consent granted to Marubeni regarding your Personal Data.

  • Right to make complaints

You have the right to submit complaints to relevant data protection authorities if Marubeni has failed to comply with the applicable law.

Marubeni will try to respond to all requests to exercise the above rights within 30 days. However, it may take us longer than a month if your request is particularly complex. Marubeni generally does not charge any fee for the exercise of the above rights unless your request is unfounded, repetitive, or excessive.

ประกาศการคุ้มครองข้อมูลส่วนบุคคล

บริษัท มารูเบนิ (ประเทศไทย) จำกัด

1. คำชี้แจงของบริษัท มารูเบนิ (ประเทศไทย) จำกัด

บริษัท มารูเบนิ (ประเทศไทย) จำกัด ("บริษัทฯ" "เรา" หรือ "ของเรา") ตระหนักถึงการบริหารจัดการและการคุ้มครองข้อมูลส่วนบุคคล (ตามที่กำหนดความหมายไว้ด้านล่าง) อย่างเหมาะสมว่าเป็นความรับผิดชอบที่สำคัญในการดำเนินธุรกิจและบริการ

ด้วยเหตุนี้บริษัทฯ จึงได้ออกประกาศการคุ้มครองข้อมูลส่วนบุคคล ("ประกาศฯ") เพื่อชี้แจงเกี่ยวกับการเก็บรวบรวม การใช้ และการเปิดเผย (ต่อไปนี้จะเรียกรวมกันว่า "การประมวลผล") ข้อมูลส่วนบุคคลของท่าน ไม่ว่าข้อมูลส่วนบุคคลดังกล่าวจะเกี่ยวข้องกับท่านในฐานะลูกค้า ผู้ที่อาจเป็นลูกค้าใหม่ ผู้จัดหาสินค้า/ผู้ให้บริการ ผู้ติดต่อประสานงาน ตัวแทน หรือบุคลากรของบุคคลดังกล่าว ตลอดจนผู้มาติดต่อ หรือเจ้าหน้าที่ของรัฐ ("ท่าน" หรือ "ของท่าน")

บริษัทฯ จะดำเนินการที่เหมาะสมเพื่อกำกับดูแลให้บุคลากรของเราปฏิบัติตามประกาศฯ นี้

2. ขอบเขตของประกาศฯ

ประกาศฯ ฉบับนี้จะนำมาใช้บังคับกับทุกช่องทางการสื่อสารทั้งแบบออนไลน์และออฟไลน์ ไม่ว่าจะเป็นในลักษณะพูดคุยกันโดยตรงแบบเห็นหน้ากัน (Face-to-Face)  ทางโทรศัพท์ หรือผ่านวิธีการอื่นใดที่ใช้ในการสื่อสารสำหรับกิจกรรมใดก็ตามเว้นแต่จะมีนโยบายคุ้มครองข้อมูลส่วนบุคคลอื่นใช้บังคับ

3. การปรับปรุงประกาศฯ

ประกาศฉบับนี้อาจมีการปรับปรุงเป็นระยะเพื่อให้สอดคล้องกับการเปลี่ยนแปลงกฎหมายคุ้มครองข้อมูลส่วนบุคคล กฎหมายที่เกี่ยวข้องอื่น และแนวทางปฏิบัติของบริษัทฯ โดยบริษัทฯ จะระบุหมายเลขฉบับและวันที่ของประกาศฯ ไว้เพื่อความสะดวกของท่าน 

บริษัทฯ ขอแนะนำให้ท่านกลับมาอ่านประกาศฯ เป็นระยะเพื่อจะได้รับทราบการเปลี่ยนแปลง และหากการเปลี่ยนแปลงใด ต้องได้รับความยินยอมจากท่านตามกฎหมายที่เกี่ยวข้อง บริษัทฯ จะขอความยินยอมจากท่านเป็นการล่วงหน้า

4. วิธีติดต่อกับบริษัทฯ

หากท่านมีข้อสงสัยประการใด หรือต้องการใช้สิทธิเกี่ยวกับข้อมูลส่วนบุคคลของท่าน ท่านสามารถติดต่อฝ่าย บริหารความเสี่ยง ของบริษัทฯ ได้ตามรายละเอียดต่อไปนี้:

5. ข้อมูลส่วนบุคคล

ตามประกาศฉบับนี้ "ข้อมูลส่วนบุคคล" หมายถึง ข้อมูลที่เกี่ยวข้องกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ ไม่ว่าทางตรงหรือทางอ้อม

6. การเก็บรวบรวมข้อมูลส่วนบุคคล

บริษัทฯ จะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านที่ท่านให้มา หรือข้อมูลที่เก็บรวบรวมไว้ในกระบวนการจัดหาสินค้าและให้บริการ ข้อมูลที่บุคคลภายนอกจัดส่งให้ หรือข้อมูลที่ได้รับจากแหล่งข้อมูลภายนอก โดยข้อมูลส่วนบุคคลของท่านที่จะเก็บรวบรวมไว้จะรวมถึงและไม่จำกัดเพียงข้อมูลต่อไปนี้:

  • ข้อมูลระบุตัวตน

ชื่อนามสกุล อายุ วันเกิด ข้อมูลการทำงาน ตำแหน่งงาน ลายมือชื่อ หมายเลขทะเบียนรถ ข้อมูลบัญชีธนาคาร รูปถ่ายและภาพเคลื่อนไหวของท่าน ข้อมูลบัตรประจำตัวประชาชน ข้อมูลหนังสือเดินทาง ข้อมูลใบขับขี่ ข้อมูลในเอกสารประจำตัวประเภทอื่นที่รัฐออกให้ (ไม่รวมข้อมูลที่มีความอ่อนไหว) และข้อมูลอื่นใดที่สามารถยืนยันตัวตนของท่านได้ (จะเรียกรวมกันว่า "ข้อมูลระบุตัวตน")

  • ข้อมูลติดต่อ

หมายเลขโทรศัพท์ส่วนตัวหรือหมายเลขโทรศัพท์เพื่อติดต่อธุรกิจ หมายเลขโทรศัพท์มือถือ หมายเลขโทรสาร ที่อยู่และที่อยู่อีเมล ตลอดจนโปรไฟล์โซเชียลมีเดียของท่าน (จะเรียกรวมกันว่า "ข้อมูลติดต่อ")

  • ข้อมูลด้านธุรกิจ

ข้อมูลด้านธุรกิจที่ท่านทำกับบริษัท ข้อมูลสัญญา บริการและผลิตภัณฑ์ที่ซื้อ ประวัติการติดต่อ กรรมการบริษัทและผู้ถือหุ้น ความเห็น ข้อสงสัย ข้อซักถาม คำติชม และการตอบแบบสำรวจ (จะเรียกรวมกันว่า "ข้อมูลด้านธุรกิจ")

  • ข้อมูลที่มีความอ่อนไหว

ศาสนา และกรุ๊ปเลือด (จะเรียกรวมกันว่า "ข้อมูลที่มีความอ่อนไหว")

  • คุกกี้ และข้อมูลเว็บบีคอน

ข้อมูล IP Address คุกกี้ เว็บบีคอน ล็อก เบราว์เซอร์ และอุปกรณ์ เวลาใช้งาน และข้อมูลการเข้าใช้งาน (จะเรียกรวมกันว่า "คุกกี้ และข้อมูลเว็บบีคอน")

ในบางกรณี บริษัทฯ ไม่ได้มีความประสงค์จะประมวลผลข้อมูลที่มีความอ่อนไหวของท่าน อย่างไรก็ตาม เนื่องจากข้อมูลดังกล่าวอาจมีระบุไว้ในเอกสารประจำตัว เช่น บัตรประจำตัวประชาชน ซึ่งบริษัทฯ อาจจะปกปิดหรือขอให้ท่านปกปิดข้อมูลที่อยู่ในเอกสารดังกล่าวเพื่อที่จะได้ไม่ต้องประมวลผลข้อมูลที่มีความอ่อนไหวซึ่งไม่จำเป็น

หากท่านให้ข้อมูลส่วนบุคคลของผู้อื่นแก่บริษัทฯ ท่านต้องดำเนินการให้มั่นใจและรับประกันว่าท่านมีอำนาจในการดำเนินการดังกล่าวตามประกาศฉบับนี้ และบุคคลผู้นั้นได้รับแจ้งเกี่ยวกับประกาศนี้เรียบร้อยแล้ว

7. ข้อมูลส่วนบุคคลของผู้เยาว์

ตามปกติกิจกรรมของบริษัทฯ  ไม่ได้เกี่ยวข้องกับบุคคลที่ยังเป็นผู้เยาว์ หากบริษัทฯ ทราบว่าได้ทำการเก็บรวบรวมข้อมูลส่วนบุคคลของผู้เยาว์ บริษัทฯ จะปฏิบัติตามกฎหมายที่เกี่ยวข้องโดยทันที หากท่านเป็นผู้เยาว์และยินยอมให้เราประมวลผลข้อมูลส่วนบุคคลของท่าน ท่านต้องชี้ให้เห็นว่าผู้แทนโดยชอบธรรมของท่านยินยอมให้ท่านดำเนินการดังกล่าว

8. การประมวลผลข้อมูลส่วนบุคคล

บริษัทฯ จะประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ที่ระบุไว้ด้านล่างตามฐานทางกฎหมาย เช่น ฐานความยินยอมของท่าน ฐานการปฏิบัติหน้าที่ตามสัญญา ฐานประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ ฐานปฏิบัติตามกฎหมาย ฐานประโยชน์สำคัญต่อชีวิต และฐานการก่อตั้งสิทธิเรียกร้องตามกฎหมาย และการยกข้อต่อสู้สิทธิเรียกร้องตามกฎหมาย

ในกรณีที่บริษัทฯ ประมวลผลข้อมูลส่วนบุคคลของท่านตามฐานความยินยอม ท่านสามารถเพิกถอนความยินยอมได้ทุกเมื่อตามที่ระบุไว้ในข้อ 13 โดยติดต่อบริษัทฯ ตามรายละเอียดข้อ 4

ข้อมูลส่วนบุคคลของท่านมีความจำเป็นสำหรับวัตถุประสงค์ด้านล่าง ซึ่งหากไม่ได้รับข้อมูลดังกล่าวบริษัทฯ อาจไม่สามารถดำเนินการตามที่วัตถุประสงค์ที่กำหนดไว้ ซึ่งวัตถุประสงค์ในการประมวลผลจะรวมถึงวัตถุประสงค์ในเรื่องต่อไปนี้ (จะเรียกรวมกันว่า "วัตถุประสงค์ที่กำหนดไว้ในประกาศฯ")

  • วัตถุประสงค์ทางธุรกิจ

ข้อมูลระบุตัวตนของท่าน ข้อมูลติดต่อ และข้อมูลด้านธุรกิจของท่านจะได้รับการประมวลผลตามฐานการปฏิบัติตามสัญญา และฐานผลประโยชน์อันชอบด้วยกฎหมายของบริษัทฯ เพื่อพิจารณาว่าจะเข้าทำสัญญากับท่าน หรือบริษัทของท่านหรือไม่ เพื่อยืนยันและพิสูจน์ตัวตนของท่าน เพื่อจัดเก็บบันทึกและหลักฐาน เพื่อสั่งสินค้าหรือบริการ เพื่อแจ้งราคา เพื่อติดต่อบริษัทของท่านเกี่ยวกับสัญญาต่าง ๆ เพื่อปฏิบัติภาระหน้าที่ตามสัญญา เพื่อจัดหาสินค้าและให้บริการแก่บริษัทของท่าน เพื่อวิเคราะห์และจัดเตรียมข้อมูลสำหรับการสั่งซื้อ เพื่อบริหารจัดการสินค้าที่ส่งมอบและจัดส่ง  เพื่อบริหารจัดการการชำระเงิน เพื่อให้บริการหลังการขาย เพื่ออำนวยความสะดวกในการทำธุรกรรม เพื่อจัดการกรณีการคืนสินค้า และการดำเนินการอื่น ๆ

  • วัตถุประสงค์ในการให้ข้อมูล

ข้อมูลระบุตัวตน ข้อมูลติดต่อ และข้อมูลด้านธุรกิจของท่านจะได้รับการประมวลผลตามข้อผูกพันตามฐานประโยชน์อันชอบด้วยกฎหมายของบริษัทฯ เพื่อวิเคราะห์และตอบความเห็น ข้อสงสัย ข้อซักถาม หรือคำติชมของท่าน เพื่อให้ข้อมูลเกี่ยวกับผลิตภัณฑ์และบริการของบริษัทฯ แก่ท่าน เพื่อให้ข้อมูลเพื่อเพิ่มยอดขาย หรือเพื่อส่งเสริมการขาย เพื่อติดต่อราชการ และเพื่อให้ข้อมูลเกี่ยวกับข้อกำหนด และเงื่อนไขของประกาศฉบับนี้ หรือเอกสารอื่นที่เกี่ยวข้องแก่ท่าน

  • วัตถุประสงค์ในการดำเนินงาน

ข้อมูลระบุตัวตน ข้อมูลติดต่อ และข้อมูลด้านธุรกิจของท่านจะได้รับการประมวลผลตามฐานประโยชน์อันชอบด้วยกฎหมายของบริษัทฯ เพื่อบริหารจัดการและปรับปรุงการประกอบธุรกิจให้ดีขึ้น เพื่อทำการตรวจสอบ จัดการการปฏิบัติตามข้อกำหนดทางธุรกิจภายใน เพื่อดำเนินการตามข้อกำหนดและเงื่อนไข ประกาศฉบับนี้ หรือเอกสารที่เกี่ยวข้อง  ทำการวิจัยตลาดและวิเคราะห์การวิจัยตลาด พัฒนาผลิตภัณฑ์และบริการ วิเคราะห์ประสิทธิภาพของการส่งเสริมการขายและโฆษณา กำหนดกลยุทธ์ให้เหมาะกับความต้องการของลูกค้า วิเคราะห์ช่องทางสื่อสารทั้งแบบออนไลน์และออฟไลน์ เพิ่มการรักษาความปลอดภัยทางออนไลน์ และเพื่อวัตถุประสงค์ด้านการดำเนินการอื่น

  • วัตถุประสงค์ในการปฏิบัติตามกฎหมาย

ข้อมูลระบุตัวตน ข้อมูลติดต่อ และข้อมูลด้านธุรกิจของท่านจะได้รับการประมวลผลตามฐานการปฏิบัติตามกฎหมายเพื่อกระทำการตามภาระหน้าที่ตามกฎหมายของบริษัทฯ และสิทธิตามกฎหมายที่เกี่ยวข้อง เพื่อก่อตั้งสิทธิเรียกร้องตามกฎหมาย การใช้สิทธิตามกฎหมาย หรือการยกข้อต่อสู้สิทธิเรียกร้องตามกฎหมายในภายหน้า ตลอดจนเพื่อวัตถุประสงค์อื่นในการปฏิบัติตามกฎหมาย

  • วัตถุประสงค์ด้านความปลอดภัย

ข้อมูลระบุตัวตนของท่าน โดยเฉพาะภาพเคลื่อนไหวของท่านที่กล้องวงจรปิดจับภาพไว้จะได้รับการประมวลผลตามฐานประโยชน์อันชอบด้วยกฎหมายของบริษัทฯ เพื่อรักษาความปลอดภัย 

  • วัตถุประสงค์ในการการระบุตัวตนและการบันทึก

ข้อมูลที่มีความอ่อนไหวของท่านตามที่ระบุไว้ในเอกสารประจำตัวนั้นจะได้รับการประมวลผลโดยต้องได้รับความยินยอมจากท่านเพื่อใช้ในการพิสูจน์และยืนยันตัวตนของท่าน และเพื่อเก็บไว้เป็นบันทึกหลักฐาน

9. การเก็บรักษาข้อมูลส่วนบุคคล

บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้นานเท่าที่จำเป็นเพื่อทำตามวัตถุประสงค์ที่กำหนดไว้ในประกาศฯ หากมีการฟ้องร้องดำเนินคดี ข้อมูลส่วนบุคคลของท่านอาจได้รับการเก็บรักษาไว้จนกว่าคดีจะสิ้นสุดลง โดยจะรวมถึงระยะเวลาในการอุทธรณ์ด้วย จากนั้นจะมีการลบทิ้งหรือเก็บไว้เป็นการถาวรตามแต่ที่กฎหมายที่เกี่ยวข้องได้อนุญาตไว้

10. มาตรการรักษาความปลอดภัย

บริษัทฯ จะใช้มาตรการรักษาความปลอดภัยทั้งในเชิงกายภาพภาพและทางอิเล็กทรอนิกส์ที่เหมาะสมในการเก็บรักษาข้อมูลส่วนบุคคลของท่าน และจะป้องกันไม่ให้ข้อมูลสูญหาย ถูกใช้ เข้าถึง เสียหาย ถูกทำลาย ถูกเปลี่ยนแปลง หรือได้รับการเปิดเผยโดยไม่ได้รับอนุญาต มาตรการรักษาความปลอดภัยเชิงกายภาพจะรวมถึงการมีตู้ที่มีการใส่กุญแจ และสถานที่มีการควบคุมการเข้าออก ส่วนมาตรการรักษาความปลอดภัยทางอิเล็กทรอนิกส์จะได้แก่การควบคุมการเข้าถึงอย่างจำกัด และการป้องกัน ไวรัส นอกจากนี้บริษัทฯ จะดำเนินการแก้ไขทันทีที่เกิดเหตุการณ์ด้านความปลอดภัย

11. การเปิดเผยข้อมูลส่วนบุคคล

เพื่อวัตถุประสงค์ที่กำหนดไว้ข้างต้น บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อบริษัทแม่ บริษัทในเครือ บริษัทย่อย บริษัทในกลุ่ม พันธมิตรทางธุรกิจ ผู้ให้บริการ IT Solution ผู้จัดหาสินค้า/ผู้ให้บริการ ลูกค้า ผู้รับจ้างช่วง ที่ปรึกษาภายนอก ผู้สอบบัญชี  หน่วยงานราชการ หรือบุคคลภายนอกรายอื่น ไม่ว่าจะเป็นเอกชนหรือทางราชการ โดยบริษัทฯ จะดำเนินการอย่างเหมาะสมเพื่อให้ผู้ที่ได้รับข้อมูลส่วนบุคคลของท่านมีมาตรฐานการรักษาความปลอดภัยของข้อมูลส่วนบุคคลที่เพียงพอตามกฎหมายที่เกี่ยวข้อง

บริษัทฯ อาจทำการเปิดเผย ให้ หรือโอนข้อมูลส่วนบุคคลของท่านหากบริษัทฯ ขายหรือโอนธุรกิจหรือทรัพย์สินบางส่วนทั้งหมดไป ซึ่งรวมถึงแต่ไม่จำกัดเพียงการควบรวมกิจการ การซื้อกิจการ หรือการร่วมค้า

12. การถ่ายโอนข้อมูลส่วนบุคคลระหว่างประเทศ

บางครั้งบริษัทฯ อาจเปิดเผย ให้ และถ่ายโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศซึ่งอาจมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลด้อยกว่ามาตรการตามกฎหมายของประเทศไทย เช่น ญี่ปุ่น เพื่อวัตถุประสงค์ที่กำหนดไว้ในประกาศฯ ซึ่งในกรณีดังกล่าวบริษัทฯ จะขอความยินยอมอย่างชัดแจ้งจากท่านก่อนที่จะดำเนินการดังกล่าว และกำกับดูแลว่าผู้ที่จะได้รับข้อมูลส่วนบุคคลของท่านมีมาตรฐานการรักษาความปลอดภัยของข้อมูลส่วนบุคคลที่เพียงพอตามกฎหมายที่เกี่ยวข้อง

13. สิทธิของท่าน

ท่านจะมีสิทธิในข้อมูลส่วนบุคคลของท่านตามที่ระบุไว้ด้านล่าง กรุณาติดต่อบริษัทฯ ตามรายละเอียดที่ให้ไว้ในข้อ 4 หากท่านต้องการใช้สิทธิดังกล่าว ทั้งนี้บริษัทฯ อาจขอให้ท่านยืนยันตัวตนก่อนที่บริษัทฯ จะปฏิบัติตามคำขอหรือการใช้สิทธิของท่านเพื่อคุ้มครองความเป็นส่วนตัวและความปลอดภัยของท่านเอง

  • สิทธิในการเข้าถึงข้อมูลส่วนบุคคล

ท่านมีสิทธิในการเข้าถึงหรือขอสำเนาข้อมูลส่วนบุคคลของท่าน ซึ่งบริษัทฯ จะให้สิทธิท่านในการเข้าถึงข้อมูลส่วนบุคคลที่มีอยู่ในเอกสารที่ท่านร้องขอเท่านั้น ไม่ใช่เอกสารทั้งฉบับ

  • สิทธิในการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง

ท่านมีสิทธิที่จะแก้ไขข้อมูลส่วนบุคคลที่ไม่ครบถ้วน ไม่ถูกต้อง ทำให้เข้าใจผิด หรือข้อมูลที่ไม่เป็นปัจจุบัน

  • สิทธิในการขอโอนย้ายข้อมูลส่วนบุคคล

ท่านมีสิทธิที่จะได้รับข้อมูลส่วนบุคคลของท่านที่ท่านได้ให้ไว้กับบริษัทฯ หรือขอโอนข้อมูลส่วนบุคคลของท่านไปยังบุคคลภายนอกหากข้อมูลส่วนบุคคลดังกล่าวได้รับการประมวลผลด้วยความยินยอมของท่านหรือได้รับการประมวลผลตามสัญญา

  • สิทธิในการคัดค้าน

ท่านมีสิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านในบางกรณี

  • สิทธิในการลบข้อมูล

ท่านมีสิทธิที่จะขอให้บริษัทฯ ลบ ทำลาย หรือปิดบังชื่อในข้อมูลส่วนบุคคลของท่านได้ในบางกรณี ซึ่งรวมถึงแต่ไม่จำกัดเพียงเมื่อข้อมูลส่วนบุคคลที่ไม่จำเป็นสำหรับวัตถุประสงค์ที่กำหนดไว้ในประกาศฯ อีกต่อไป หรือเมื่อข้อมูลส่วนบุคคลของท่านได้รับการเก็บรวบรวม ใช้ หรือเปิดเผยโดยมิชอบด้วยกฎหมาย

  • สิทธิในการจำกัดการใช้ข้อมูล

ท่านมีสิทธิที่จะขอให้บริษัทฯ จำกัดการใช้ข้อมูลส่วนบุคคลของท่านในบางกรณี 

  • สิทธิในการเพิกถอนความยินยอม

ท่านมีสิทธิที่จะเพิกถอนความยินยอมที่ท่านได้ให้บริษัทฯ ไว้เกี่ยวกับข้อมูลส่วนบุคคลของท่านได้ตลอดเวลา

  • สิทธิในการร้องเรียน

ท่านมีสิทธิยื่นคำร้องต่อหน่วยงานคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้องหากบริษัทฯ ไม่ปฏิบัติตามกฎหมายที่เกี่ยวข้อง

บริษัทฯ จะดำเนินการกับคำขอใช้สิทธิข้างต้นภายใน 30 วัน อย่างไรก็ตามบริษัทฯ อาจต้องใช้เวลานานกว่าหนึ่งเดือนหากคำขอของคุณมีความซับซ้อนเป็นพิเศษ ตามปกติบริษัทฯ จะไม่เรียกเก็บค่าธรรมเนียมใด ๆ สำหรับการใช้สิทธิข้างต้นเว้นแต่คำขอของท่านไม่มีเหตุผลอันสมควร เป็นคำขอที่ซ้ำซ้อน หรือมากเกินความจำเป็น
